Placing Criminal Cases "On-File"


An aspect of Massachusetts criminal law that is relatively unusual is the practice of placing cases “on file.” This practice, included within Rule of Criminal Procedure 28, allows a defendant to avoid the imposition of a sentence after a finding of guilt, amongst other things. The Rule, which has existed in Massachusetts courts for centuries, can be greatly beneficial to defendants.
